If RWA is not registered, is it valid RWA. If not how it can be abolished

Registration of RWA comes under society registration act. And RERa act mandate for three month to form RWA.

1.The Real Estate (Regulation and Development) Act, 2016 (RERA), states that as soon as a majority of home buyers have booked their flats, an RWA should be formed within three months. Associations are not mandatory but if these are formed, it should be registered. 2.Under Section 13 and Section 14 of the Societies Registration Act, 1860, as applicable to the state, an RWA can be dissolved.

No, if RWA is not registered it is not valid since registration for such association is mandatory and in case it is to be abolished action can be taken against such RWA by various means like under CPC plaint can be filed praying for injunction against such organization and complaint shall also be made to registrar of societies and simultaneously one can also file police complaint against such organization.

RWA registration is not mandatory, it has to be registered if it aims to collect money from residents. If your developer does not take steps to form an RWA, residents themselves can form a body.
