Q. A company had a contract for supplying technical services on a success-based fee, under an R & D initiative with a PSU about 11 years back. Although the Bank Guarantee held by PSU as a performance bond was returned to the company undamaged however the payment was denied. The question is; is such a case time-barred on a platform of Alternate Dispute Resolution (ADR) Route or Outside Experts Councillors (OEC) appointed at the discretion of the PSU, particularly because of the passage of time? Can a legal notice be served upon the PSU at this point of time?
